These Terms of Service ("Terms") constitute a legally binding agreement between you and WebScan Pro, operated by Enrico Bertero ("we," "us," or "our"). By accessing or using our website accessibility scanning service (the "Service"), you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

WebScan Pro provides automated website accessibility scanning and compliance checking services, including:

  • WCAG 2.2 Level A, AA, and AAA compliance checking
  • ADA Title III compliance analysis
  • Website performance and security scanning
  • Detailed accessibility reports with remediation recommendations
  • Dashboard for tracking scan history and results

4. Eligibility and Account Registration

4.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By using the Service, you represent that you meet these requirements.

4.2 Account Registration

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You may not share your account with others or create multiple accounts

Free Plan

Professional Plan

Enterprise Plan

  • • Unlimited scans

5.1 Pricing and Billing

  • All prices are listed in Euros (EUR) and include applicable taxes
  • Subscriptions are billed monthly or annually in advance
  • Price changes will be communicated 30 days in advance
  • Payments are processed securely through Stripe

5.2 Free Trial and Refunds

  • New users receive a 14-day free trial of paid features
  • Refunds are available within 30 days of purchase for annual subscriptions
  • Monthly subscriptions can be cancelled at any time
  • Usage-based charges are non-refundable

6. Acceptable Use Policy

6.1 Permitted Uses

You may use the Service to:

  • Scan websites you own or have explicit permission to test
  • Generate accessibility reports for compliance purposes
  • Monitor accessibility improvements over time

6.2 Prohibited Uses

You may not:

  • Scan websites without proper authorization
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to reverse engineer or copy our scanning algorithms
  • Overload our systems with excessive requests
  • Share your account credentials with others
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable laws or regulations

7. Intellectual Property Rights

7.1 Our Rights

The Service, including all software, algorithms, designs, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You retain ownership of any websites you scan and the resulting accessibility reports. You grant us a limited license to access and analyze your websites solely for the purpose of providing the Service.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

GDPR Compliance

We are committed to complying with the General Data Protection Regulation (GDPR) and other applicable data protection laws. You have rights regarding your personal data as outlined in our Privacy Policy.

9. Service Availability and Support

9.1 Service Availability

  • We aim for 99.9% uptime but cannot guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance
  • We reserve the right to suspend the Service for security or maintenance reasons

9.2 Customer Support

  • Support is provided via email during business hours (9 AM - 6 PM CET)
  • Professional and Enterprise customers receive priority support
  • We aim to respond to all inquiries within 24 hours

10. Disclaimers and Limitations

10.1 Service Disclaimers

Important: Our scanning results are for informational purposes only. We do not guarantee complete accuracy or legal compliance. You should consult with accessibility professionals and legal experts for comprehensive compliance assessments.

10.2 Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

11.1 Termination by You

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of your current billing period
  • You may delete your account and data at any time

11.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason with 30 days' notice.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of Italy and the European Union. Any disputes will be resolved in the courts of Italy.

12.2 EU Consumer Rights

If you are an EU consumer, you have additional rights under EU consumer protection laws, including the right to withdraw from distance contracts within 14 days.
